1. Short title

This Act may be cited as the Geological and Soil Surveys Act.

Part I – Geological surveys

2. The Minister may order geological surveys

It shall be lawful for the Minister to order geological surveys to be made within the whole or any part of Seychelles.

3. Appointment of geological surveyors*

*Note: The Chief Development Officer has been appointed as Geological surveyor to carry a geological survey of Seychelles. (G.N. 230 and 231 of 20th June, 1977.)The President may appoint any person (hereinafter referred to as a geological surveyor) to carry out any geological survey ordered by him to be made.

4. Power of geological surveyor and of persons acting under his orders

A geological surveyor and all persons acting under his orders may enter upon any land in Seychelles and do such acts thereon as are necessary or expedient for the purposes of the survey.

5. Geological surveyors and persons acting under their orders to do as little damage as possible

A geological surveyor and all persons acting under his orders shall, at all times, do as little damage as possible in the exercise of their powers under this Act.

6. Compensation for damage done

(1)Compensation for any damage done as the result of the operations of a geological surveyor or of persons acting under his orders shall be payable by the Government of Seychelles to the person entitled thereto. Such compensation shall be determined by agreement of the parties.
(2)If the parties fail to agree on any point from the claim to compensation such matter shall be referred for arbitration by two persons one to be appointed by the Government of Seychelles and one to be appointed by the party or parties claiming compensation.
(3)In the event of such arbitrators being unable to agree, then the matter shall be referred for determination by a Judge in Chambers whose decision shall be final.

7. Offences

Any person who wilfully obstructs or interferes with a geological surveyor or any person acting under his orders in the performance of any duty or work under this Act shall be guilty of a misdemeanor and shall on conviction be liable to imprisonment for a term not exceeding two years or to a fine not exceeding one thousand rupees or to both such imprisonment and fine.

Part II – Soil surveys

8. Minister may order soil surveys

It shall be lawful for the Minister to order soil surveys to be made within the whole or any part of Seychelles.

9. Part I to apply mutatis mutandis

The provisions of Part I shall apply mutatis mutandis in the case of surveys ordered to be made under section 8.

Part III – Regulations

10. Power to make regulations

(1)The Minister may make regulations for carrying the objects of this Act into effect, and, without prejudice to the generality of this power may make regulations defining and extending the powers of geological surveyors, of persons carrying out soil surveys and of persons acting under their orders.
(2)Regulations made under this section may contain provisions for imposing on persons offending against the provisions thereof a fine not exceeding one thousand rupees and imprisonment not exceeding two years.
