1. Short title

This Act may be cited as the Beach Control Act.

2. Interpretation

In this Act—"beach" means any part of the seashore;"inshore waters of the sea" means that portion of the sea which lies within a distance seaward of one thousand yards from low‑water mark at the lowest tides;"seashore" means that part of the land which is alternately covered and uncovered by the sea at the highest and lowest tides.

3. Regulations for controlling use of the seashore and inshore waters

(1)The Minister may, from time to time, make such regulations as appear to him to be necessary or expedient for the purpose of preserving the natural amenities of the seashore and of preventing danger, obstruction or annoyance to persons using the seashore or bathing in the sea.
(2)Without any prejudice whatever to the generality of subsection (1), such regulations may—
(a)prohibit the use of pleasure boats within such areas of the inshsore waters of the sea as may be prescribed;
(b)regulate the speed of pleasure boats within the inshore waters of the sea;
(c)regulate the use of pleasure boats within the inshore waters of the sea so as to prevent their navigation in a dangerous manner or without due care and attention or without reasonable consideration for other persons;
(d)require the use within the inshore waters of the sea of effectual silencers on pleasure boats propelled by internal combustion engines;
(e)prohibit or regulate fishing by such means as may be prescribed within such areas of the inshore waters of the sea as may be prescribed;
(f)prohibit or regulate the engaging in, or playing of, such games or water sports on the seashore or within the inshore waters of the sea as may be prescribed.
(g)prohibit or regulate the driving or parking of any vehicle on the seashore;
(h)make provision for the control on the seashore, or the exclusion therefrom, of animals;
(i)prohibit or regulate the selling or offering for sale on the seashore of any article, commodity, service or thing;
(j)prohibit or regulate the erection or placing on the seashore of any booths, tents, sheds, stands, stalls, vehicles or other erections (whether fixed or movable) for the sale or exposure of any article, commodity or thing, or for the provision of any service or any form of entertainment;
(k)prohibit or regulate the disposal of litter or the discarding of such objects as may be prescribed;
(l)otherwise make provision for avoiding accidents to persons using the seashore and bathing in the sea, for preserving order and good conduct on the seashore and within the inshore waters of the sea and for preventing nuisances in relation thereto.
(m)prescribe licences for pleasure boats, commercial ski boats, paragliding and water sports operations;
(n)prescribe the forms of licences;
(o)prescribe the conditions to be satisfied for the issue of licences;
(p)regulate the issue, renewal, suspension or cancellation of licences;
(q)prescribe the forms of application for licence to be used;
(r)prescribe fees in relation to the issue, renewal, suspension or cancellation of licence.
(3)Such regulations may—
(a)be expressed to apply to the whole of the seashore of Seychelles or of such island or islands in Seychelles or to such beaches thereof as may be specified in the regulations;
(b)make different provision as respects different cases or classes of case and for different purposes;
(c)impose conditions and make exceptions;
(d)confer functions on prescribed persons; and
(e)contain such incidental or supplemental provisions as may appear to the Minister to be expedient for the purposes of this Act and such regulations.
(4)Any regulations made under this section may provide that any person contravening or failing to comply with any provision of the regulations shall be guilty of an offence and liable on conviction to the fine not exceeding five thousand rupees or imprisonment for a term not exceeding two years or both such fine and imprisonment.
