Republic vs Yian Emmanuel Jules (CO 50 of 2023) [2023] SCSC 826 (11 September 2023)

1. The convict is 32 years old with no children, working as a Stevedore earning around SCR8000 to SCR9000 per month.  The convict does not have any previous convictions.  The offence being convicted of is having in possession 10 plants of Cannabis and it is a Class B drug which I can say are of not much of commercial value and I do not see any other aggrevating factors.

2. I impose the following sentence:

1.         I sentence the convict to 6 months imprisonment suspended for 1 year and the convict is not to commit any similar offence within the period of one year;

2.         In addition I also impose a fine of SCR10,000 to be paid within 6 months of today.  The fine can be paid by instalment.

3.         In default the convict is to serve 6 months imprisonment.

3. The convict can appeal against the sentence within 30 working days.
