Rescission, breach of agreement, damages

i) The Plaint is dismissed; 

ii) The Plaintiff is in breach of the contractual agreement and as such pays the
Defendant damages in the sum ofEUR448,175.70;

(iii) The Plaintiff is prevented from further using the Defendant's brand name;

(iv) Costs are ordered against the Plaintiff; and

(v) Interest is awarded at the commercial rate in the sum ofEUR448,175.70; from the date of the filing of the Plaint until such time when the total sum is paid to the Defendant.
