Rosebelle (Pty) Ltd v Remoto (MA 164 of 2024) [2025] SCSC 53 (4 April 2025)

1. MADELEINE, J

1. This is an application for the stay of execution of a Judgment of the Employment Tribunal in case ET25/2021 Remoto v. Rosebelle (Pty) Ltd delivered on 21^st May 2024. 

2. The application arises from a notice of appeal filed in case CA17/2024 Rosebelle (Pty) Ltd v Remoto on 28^th June 2024 (“CA17/2024”).

3. The appeal in CA17/2024 is subject to the application of Rosebelle (Pty) Ltd in case MC 34/2024 Rosebelle (Pty) Ltd v Remoto for an extension of time to file notice of appeal and for the appeal to be heard (hereinafter referred to as “MC34/2024”).

4. The application in MC34/2024 has been refused and stands dismissed[1].

5. Therefore, there being no appeal and/or order to extend the time to file notice of appeal out of time, the application for stay of execution does not arise for determination.

6. Application is refused and dismissed.
