Appellant

Versus

The Republic Respondent

Heard: 10 April 2017

Counsel: Mr. France Bonte for the Appellant

Ms. Amanda Faure for the Respondent

Delivered: 21 April 2017

ORDER

J. Msoffe (J.A)

[1] The Appellant, a 71-year old person at the time of trial, was convicted on his own plea of guilty to the offence of sexual assault of his 4-year old granddaughter. He was sentenced to a term of 10 years imprisonment.

[2] Aggrieved, he has preferred this appeal against sentence.

[3] At the hearing of the appeal on 10th April 2017 we told the Appellant that should the appeal fail he runs the high risk of enhancement of sentence in view of the seriousness of the offence he had committed.

[5] On reflection, he decided not to pursue the appeal and accordingly withdrew it.

[6] In the event, we marked the appeal withdrawn.
