RULING

On Application For Appointment of Executrix

Gaswaga, J

This is an application for appointment of executrix. I am satisfied on the documentary evidence adduced in support thereof that Marguerite Moustache nee Dias died intestate in Seychelles on the 22^nd October, 2006. At the time of death the deceased had immovable property and accounts at Seychelles Mercantile Banking Corporation better known as Nouvobanq, at the Seychelles Savings Bank and at the Seychelles Credit Union.

The tenth applicant is under no legal incapacity and is able and willing to be appointed executrix of the succession of the late Marguerite Moustache nee Dias and to carry out the duties of executrix as laid down by the law. All the heirs accept the appointment of the tenth applicant as executrix to the succession of their late mother Marguerite Moustache nee Dias.

In the terms of Section 1026 of the Civil Code of Seychelles I appoint Tracey Alice Moustache as executrix of the succession of the late Marguerite Moustache nee Dias.
