ORDER

Roger Eulentin, the 1st accused in criminal case number 31 of 2005 now the applicant, has filed an application and accompanying affidavit moving the Court to vary the conditions of bail on which he was released. He averred that he had entered into a contract of employment with Deroches Island Resort Ltd where he is to work as a gardener and as such, if he was to take up this employment he will not be in the position to fulfill bail condition number five(5) which states as follows;-


(5) The accused should report to the nearest police station being the Central Police Station every Monday and Friday before midday.”


One Mr. Joseph Labonte, the Human Resources Manager of the said resort confirmed this in court and also signed a bail bond form in the sum of SR20, 000/- on behalf of the applicant.


Accordingly this Court varies the said bail conditions by the canceling of ONLY condition number five (above). The accused is however warned to attend his trial on Thursday 19th and Friday 20th July, 2007 at 9am for the whole.
