M A SO BORN S ….............................................................................................RESPONDENT

Divorce Side No 136 of 2010

Mr. F. Ally for the Petitioner

JUDGMENT

B. Renaud J

On 9th April, 1996 the Petitioner Mr. L E S Shena of ‘Kan Frichot’, La Louise, Mahe Seychelles, was married to the Respondent Mrs. M-A S born S C/O C B of Premier Building, Victoria, Mahe, Seychelles.

After their marriage the parties cohabited at Beau Vallon, Mahe, Seychelles.

The Petitioner is domiciled and resident in Seychelles and is a Seychellois national. The Respondent is domiciled and resident in the Kingdom of Bahrain and is a Seychellois national.

There have been no previous proceedings in any Court of Seychelles in relation to the marriage.

The Petitioner averred that the marriage has irretrievably broken down.

The parties have lived separate and apart for a continuous period of over one year immediately preceding the presentation of this Petition and the Respondent consented to the divorce.

All attempts to reconcile the parties have not proved successful.

On the basis of the uncontroverted evidence of the Petitioner, it is my judgment that the marriage of the parties has broken down irretrievably and that there is now no possibility of reconciliation.

I hereby dissolved the said marriage and grant a conditional order of divorce to be made absolute six weeks from today.

I make no order as to cost.
