Burhan J

[1]               I have considered the plea in mitigation made by learned counsel for the 1st accused.  I consider the fact that he is a first offender.  I also consider the fact by pleading guilty he has saved the precious time of Court and this is a 2013 case.

[2]               I proceed to sentence the 1st accused to a term of 3 months imprisonment which I suspend for the period of 2 years in respect of Count 4 and a fine of SR1,500 on Count 4.  In respect of Count 5, I sentence him to a term of 3 months imprisonment which I suspend for a period of 2 years and a fine of SR1,500.

[3]               In default of payment of the total fine of SR3,000 the accused shall serve 3 months imprisonment.  The 1st accused is to pay the fine of SR 3,000 by 30th September 2016.
