JUDGMENT

[1]       On the application of the Petitioner, I find that the Petitioner Stella Lucina Amade born Sultan of Flat 41 Roche Caiman, Mahe, Seychelles, was married to Barry Paul Sandy Amade on the 9th of November 2003 at Roche-Caiman in Seychelles. Both the Petitioner and Respondent are Seychellois nationals and the Petitioner is currently residing in Seychelles.  There is one child of their marriage namely Rubina Zena Amade born on the 28th September year 2000.

[2]       On the uncontroverted evidence of the Petitioner, I find that the marriage has irretrievably broken down in that the Petitioner and the Respondent have been living separately and apart for a period of more than 10 years and that there is no possibility of reconciliation.  I therefore grant a Conditional Order of Divorce in favor of the Petitioner which Order shall be made absolute at the expiration of six weeks from today.

[3]       As the child of the marriage will be 18 years in September, I shall not order the Tribunal to make a custody order for the child.
