Delict: where the Government without permission of a landowner builds a road on the land, to the benefit of a license holder under the Broadcasting and Telecommunications Act 2000, such action amounts to a faute in relation to the Government. However, a landowner may not claim a delict against a license holder for damage to their property but must use the Broadcasting and Telecommunication Act 2000 to claim compensation arising from damage to their property by the licensee.
