Conspiracy to commit the offence of importing a controlled drug contrary to Section 16 (a) read with Section 5 of the Misuse of Drugs Act, 2016 and punishable under the Second Schedule to the said Act.

R v Tembe (CO 25/2019) [2019] SCSC 1018 (19 November 2019);


[1]       The convict, Nilzo Julia Tembe, has on her own plea been found guilty of trafficking in a controlled drug, namely 5307.7 grams of cannabis by means of transporting the same, contrary to section 7 (1) read with section 2 punishable under section 7 (1) as read with sections 7(4) and 48(1) (a) and with the Second Schedule of the Misuse of Drugs Act 2016.

Republic v Morel (CO 31/2018) [2019] SCSC 518 (28 June 2019);


[1]        The Convict, Mathieu Morel, stands convicted of one count of sexual assault contrary to Section 130 (1) read with Section 130 (2)(d) and Section 130 (3)(b) and punishable under Section 130 (1) of the Penal Code.

[2]        The facts which resulted in the conviction are well set out in the judgment delivered by this Court on 31st May 2019. Suffice to state that the Convict had sexual intercourse with N.L, a girl under the age of 15 years.
