Presidential Emoluments Act

1. Short title

This Act may be cited as the Presidential Emoluments Act.

2. Salary and gratuity of the President

There shall be paid to the President—
(a)a monthly salary of R38,000 payable in arrears; and
(b)at the end of each year or, where the office of President becomes vacant before the end of a year, on the occurrence of the vacancy, a gratuity of an amount equal to 25% of the total salary for that year or that part of the year, as the case may be.
(c)upon ceasing to hold the office of President, otherwise than by being removed under article 54 of the Constitution, a gratuity of an amount equal to 50% of the total salary paid for the immediately preceding period of office as President.

3. Pension and gratuity of person ceasing to be President

(1)There shall be paid to a person ceasing to hold the office of President otherwise than by being removed under article 54 of the Constitution—
(a)a monthly pension payable in arrears of an amount equal to 75% of the monthly salary of the President under section 2(a); and
(b)at the end of each year or, where the payment for any reason ceases before the end of a year, on the occurrence of such event, a gratuity of an amount equal to 75% of the gratuity payable to the President under section 2(b).
(2)Subsection (1) applies to a person who has held the office of President under the Constitution promulgated on 21st June, 1993 or under any previous Constitution of Seychelles.
(3)A Pension or gratuity payable under subsection (1) shall cease if the person to whom such pension or gratuity is paid is elected President or paid any salary, gratuity or pension under the Ministerial Emoluments Act or the National Assembly Members' Emoluments Act.

4. Exemption from tax

The salary, gratuity and pension paid under this Act shall be exempt from tax on income or profits.
