Radio Communication (Islands) Decree

Decree 27 of 1978

1.

This Decree may be cited as the Radio Communication (Islands) Decree.

2.

(1)In this Decree, unless the context otherwise requires:—"Government officer" means an officer of the Government of Seychelles and includes a police officer, a member of the Security forces, an agent or servant of the Government, any person working in conjunction with a department of the Government and any other person authorised by the Minister to exercise the powers conferree by this Decree;"Inhabited island" means any island occupied by one or more persons for any period exceeding 48 hours;"Island in private ownership" includes an held on lease or by a person who has a usufructuary or any other beneficial interest in such island;"Owner" includes a lessee, a usufructuary or any person having a beneficial interest in the island.
(2)Government officer shall be deemed to visit an island for the purpose of performing his duties if the purpose of such visit is to ensure that a radio receiver/transmitter or stand‑by radio receiver/transmitter has been properly installed in accordance with the provisions of Section 4, is of the required type and specification and in good working order and condition.

This Decree applies to any island specified in the Schedule which is or becomes inhabited.

(1)Every owner of an inhabited island, notwithstanding section 4 of the Broadcasting and Telecommunication Act, shall instal, maintain and operate, on such island, a radio receiver/transmitter and also a stand‑by radio receiver/transmitter both capable of communication with and being connected into the national telephone network operated by the Cable and Wireless Seychelles on Mahe or on adjacent islands in common ownership a receiver/transmitter capable of indirect communication by relay to the main receiver/transmitter into the national telephone network.
(2)The owner of such an island on which a radio receiver/transmitter is installed in accordance with the provisions of subsection (1), shall be licensed under the Broadcasting and Telecommunication Act, for such purpose.

Any owner of an inhabited island who:—
(a)fails to instal a radio receiver/transmitter or stand‑by radio receiver/transmitter or;
(b)fails to maintain and operate a radio receiver/transmitter or stand‑by receiver/transmitter,
shall be guilty of an offence.

6.

In the event of the interruption or breakdown on the island in the service of the radio receiver/transmitter and the stand‑by radio receiver/transmitter the owner shall be guilty of an offence unless he proves that he could not reasonably have avoided such interruption or breakdown.

7.

A Government officer shall have the right of access to any island in private ownership for the purpose of performing his duties and for any purpose incidental thereto or connected therewith.

8.

The owner of an island and his agents and servants shall give all the help and the facilities necessary on the island to Government officers in the exercise of their duties conferred by this Decree.

9.

No person shall obstruct or hinder a Government officer in the execution of his duties as a Government officer on an island in private ownership or in the exercise of any power or right conferred by this Decree.

10.

The Minister may make regulations for the purpose of carrying out or giving effect to the principles and provisions of this Decree including, without prejudice to this generality, amending the Schedule.

11.

Any person who commits an offence against this Decree or the regulations made thereunder shall, on conviction, be liable to a fine not exceeding 10,000 rupees and to imprisonment for a term not exceeding 12 months or to both such fine and imprisonment.
