IN THE SUPREME COURT OF SEYCHELLES

THE REPUBLIC …..........................................................................Plaintiff

vs.

JOSSY RACHEL..............................................................................Accused

Criminal Side No. 37 of 2006

Mr. Chetty for the Republic

Mrs. Antao for the Accused

ORDER

Today, Mrs. Antao intimated to Court that she wanted to file a fresh application for release on bail if the prosecution was still objecting to the enlargement of the accused on bail by the Court. Unlike before, Mr. Chetty conceded to the application and went on to ask the Court to impose stringent conditions before finally releasing the Accused. This court, having listened to the application and prayer for the defence and, there being no objection by the State Counsel, will grant the application on the following conditions:

  1. That the accused signs a court bond of Rs.20, 000.00 with two sureties who are to be approved by the Court.

  1. That he reports to Anse Royale Police Station every Monday and Friday mornings of each week starting tomorrow.

  1. That he should never get involved in any criminal activity.

  1. That the accused surrenders his passport or any other traveling documents in his possession to the Supreme Court Registry.

  1. That he should not interfere with the witnesses or the case in general.

  1. The above bail conditions will lapse if any of them is breached and the accused will be placed back in prison on remand.

This order is to be communicated to the Commissioner of Police and the Immigration department.

I so order.
