Stepanov v Drahuradova (86 of 2007) [2008] SCSC 60 (3 February 2008)

2

IN THE SUPREME COURT OF SEYCHELLES

ING. JURAJ STEPANOV Petitioner

VS.

ING. BARBORA DRAHURADOVA Respondent

Divorce Side No. 86 of 2007

Ms. Domingue for the Petitioner

JUDGMENT

Gaswaga, J

This is a petition for a dissolution of the marriage between Juraj Stepanov, the Petitioner and Barbora Drahuradova, the Respondent which was celebrated on the 1st September, 2004 at La Digue, Seychelles as indicated on the marriage certificate tendered in Court.

It is averred that the parties, who are both employed, domiciled and resident in Bratislava, Slovak Republic, have lived apart for a continuous period of at least one year immediately preceding the presentation of this petition. That their said marriage has irretrievably broken down to the extent that any attempts at reconciliation have yielded no positive results. Further, that there are no children born of the marriage.

In his petition dated 27th May, 2007 the Petitioner is seeking a dissolution of the marriage to which the Respondent has consented. (See consent on file dated 9th March, 2007). As the Respondent has consented to the grant of the divorce in a document notarially executed before a notary in Brastislava, Slovak Republic, the Court granted leave to learned counsel for the Petitioner to make submissions based on the sworn averments in the petition. On a consideration of the submissions and other pleadings in the case, the Court is satisfied that the marriage has broken down irretrievably, and that there is now no hope of reconciliation.

Accordingly, the Court grants a conditional order of divorce. This order shall be made absolute after the expiry of six weeks from the date hereof.

D. GASWAGA

JUDGE

Dated this 4th day of February, 2008.
