                                                                                       [2018] SCSC 1159

THE REPUBLIC

versus

SAMUEL KILINDO

Heard:

Counsel:                      Mr Chinnasamy,  for the Republic

                                    Mrs Amesbury for the accused

Delivered:                   8 November 2018

[1]        I have heard counsel in mitigation. The Convict is 31 years old, he has a minor child of 7 years old and there were three persons involved in this incident who had already pleaded guilty and been convicted. One who had previous conviction was sentenced to 3 years and the other one who had no previous conviction was sentenced to 18 months.

[2]        So for this purpose I will also treat the Convict as a first offender as any conviction that he has is way back 5 years ago. He has pleaded guilty, he has saved the Court’s time and expenses of a trial. On the aggravated side although he did not take anything from the person he was the one who punched him so it a use of violence of part.

[3]        Considering that however I will also sentence you to not more than, 18 months imprisonment. The time spent on remand shall count towards your sentence that means you will spend less than year. You are also entitled to remission.

[4]        You can appeal against the sentence within 30 working days.
