The Petitioner seeks a dissolution of his marriage on the ground that he and the Respondent have lived apart for a period of over one year preceding the presentation of this petition and that the Respondent has given her consent to the granting of the divorce.
The parties were lawfully married on 21st August 1997. There is one child born on the marriage, namely Emily Mary Noel born on 28th February 2000.
The Petitioner testified that the marriage has broken down irretrievably and that there is now no hope of reconciliation. He also filed a minute of consent from the Respondent wherein she had consented to the granting of the divorce.
In the circumstances, the Court grants a conditional order of divorce. As the Family Tribunal has made orders regarding the care, custody and maintenance of the said minor child, the conditional order shall be made absolute after the expiry of six weeks from the date hereof.
