[1]               I have considered the mitigating factors and the submission of learned counsel for the Plaintiff.

[2]               The Convict is 46 years old and he is a father of three minor children, 13 years old, 11 years old and 7 years old.

[3]               He has pleaded guilty and hence save the Court’s considerable time and expenses.

[4]               He is a first offender and he has showed remorse. I note that the injury to Mrs Bouchereau was very minor.

[5]               I also note that one person lost his life during the course of the accident.

[6]               I would impose the following sentence on the Accused.

[7]                For the 2nd count; that is, causing death by reckless driving I impose the sentence of 18 months imprisonment.

[8]               On 3rd count; that is causing injury to a person I will impose a sentence of 6 months imprisonment. The sentences are to run concurrently since they arise from the same incident.

[9]               The 16 days that the Convict spent on remand shall be deducted from the sentence.

[10]           He can appeal against the sentence within 30 working days.
