  1. I have considered the mitigating factors and the submission of learned counsel for the Plaintiff.

  2. The Convict is 46 years old and he is a father of three minor children, 13 years old, 11 years old and 7 years old.

  3. He has pleaded guilty and hence save the Court’s considerable time and expenses.

  4. He is a first offender and he has showed remorse. I note that the injury to Mrs Bouchereau was very minor.

  5. I also note that one person lost his life during the course of the accident.

  6. I would impose the following sentence on the Accused.

  7. For the 2nd count; that is, causing death by reckless driving I impose the sentence of 18 months imprisonment.

  8. On 3rd count; that is causing injury to a person I will impose a sentence of 6 months imprisonment. The sentences are to run concurrently since they arise from the same incident.

  9. The 16 days that the Convict spent on remand shall be deducted from the sentence.

  10. He can appeal against the sentence within 30 working days.
