I have heard counsel in mitigation. The Convict is 44 years old a father of two minor children. He has pleaded guilty saved the Court a lengthy trial and expenses. He is already serving a life sentence for the offence of trafficking.
I note to that the offence of possession in this case contains 6.85 grams of pure drugs which is basically a trace. So taking all that into account I impose a following sentences:
Count 2 that is possession of 6.85 grams of diamorphine containing 0.41 grounds of purity. I impose a sentence of 18 months imprisonment.
Count 3 assaulting NDEA agents I impose a sentence of 1 year imprisonment.
Count 4 obstructing NDEA agents in performance of their duty also 1 year imprisonment.
All the sentences would run concurrently as they were in the same transaction and they would also run concurrent to the sentences he is now serving.
You can appeal against the sentences within 30 working days.
