[2018] SCSC 424

THE REPUBLIC

versus

DAVID-LEE PAYET

Heard:

Counsel: Mr. Joji John, for the Republic

Mr. Joel Camille for the

Delivered: 7 May 2018

[1] I have heard Counsels in mitigation. The convict is 20 years old and has no dependent. He is a first time offender and he has pleaded guilty and save the Court’s time and expenses of a trial. I note that the drug is Class B being cannabis herbal material and the amount being 32.9 grams is on the low side. There was no commercial value.

[2] I do not see any other aggravating factors and therefore I will impose a fine on the convict. I impose a fine of SR10,000. I give him six months to pay. He can pay by instalments. In default a sentence of imprisonment of six months shall be imposed. He can appeal against the sentence within 30 working days.
